Alegal / Zombie Jurisdiction

Alegal: an action the law can neither recognize as legal nor illegal because it is "incommensurate to established legal supervision," yet which exemplifies an emergent governing order (file sharing; the Transborder Immigrant Tool that positions a desert migrant as a User with full infrastructural access). Zombie jurisdiction: the residual legal form that persists while unable to describe or circumscribe the new socio-technical condition it claims to govern (the US–Mexico wedge). The pairing is Bratton's mechanism for how platform sovereignty outruns states: repeated alegal facts on the ground "take on the force of law" and, if urbanists are savvy, "designate as law." He warns the converse — "the criminalization of infrastructure" — is worse than the criminalization of culture.
